WHOIS Privacy Service Agreement
The terms that govern the optional AIvikings WHOIS Privacy service.
This WHOIS Privacy Service Agreement (the "Privacy Agreement") forms part of the Terms and Conditions and applies when you enable the optional WHOIS Privacy service on a domain registered through AIvikings. If you do not enable the service, this Privacy Agreement does not apply to that domain.
1. What the service does
When WHOIS Privacy is enabled for an eligible domain, we replace some or all of your public registrant contact details in published registration data with alternative contact details, so your underlying personal contact information is not displayed in public WHOIS or RDAP output. The alternative contact may be operated by AIvikings directly or by our upstream accredited registrar partner's privacy proxy. You remain the registrant and legal holder of the domain at all times. The service does not transfer ownership of the domain to us or to any third party.
2. Eligibility
WHOIS Privacy is available only for top-level domains and registries that permit it. Some registries do not allow privacy, require specific data to remain public, or impose their own conditions. Where a registry does not permit the service for a given domain, we will not be able to enable it, and any fee charged for it will be handled as described in the Refund and Billing Policy.
3. Your responsibilities
You must keep the real registrant contact details held in your account accurate and current, even when they are not published. Inaccurate underlying data may result in suspension under our Terms and Conditions and Registry Policies. You remain fully responsible for the domain and for all use of it, exactly as if the service were not enabled.
4. Forwarding of communications
Where the service provides a relay or forwarding contact, we may forward legitimate communications we receive at that contact to you. We may, but are not obliged to, filter communications that appear to be spam, malware, or otherwise abusive. We do not guarantee that any particular message will be forwarded or received.
5. When we may suspend or disable privacy
We may suspend or permanently disable WHOIS Privacy on a domain, and reveal the underlying registrant data, where this is required or reasonably necessary:
- To comply with applicable law, a court order, a subpoena, or a valid request from a competent authority
- To comply with ICANN policy, registry policy, or a dispute procedure such as the UDRP or URS
- In response to a valid abuse report or to address fraud, security threats, or unlawful activity
- Where required to establish, exercise, or defend legal claims
- Where your underlying registrant data is inaccurate or cannot be verified
Where lawful and reasonable, we will try to notify you, but we may act without prior notice where the law, a registry, ICANN policy, or the seriousness of the matter requires it. Disclosure of registration data is otherwise handled under our NIS-2 Disclosure Procedure, Third-Party Data Request Procedure, and Domain Registration Data Disclosure Policy.
6. Disclaimers and liability
The WHOIS Privacy service is provided on an "as is" and "as available" basis. We do not warrant that your information will be concealed in all circumstances, including where a registry, registrar, or authority requires its publication or disclosure. To the maximum extent permitted by law, our liability in relation to the service is subject to the limitations in section 10 of the Terms and Conditions. Nothing in this Privacy Agreement limits rights you have as a consumer that cannot be excluded by law.
7. Fees and cancellation
Any fee for WHOIS Privacy is shown before you enable the service. You may disable the service at any time from your account, after which your registrant data will be published in line with the applicable registry and ICANN rules and the default data-redaction practices described in our Privacy Policy.
