Uniform Domain Name Dispute Resolution Policy (UDRP)
A summary of the Uniform Domain Name Dispute Resolution Policy (UDRP) and how it applies to domains registered through AIvikings.
Every domain you register through AIvikings is subject to ICANN's Uniform Domain Name Dispute Resolution Policy (the "UDRP") and, where the relevant registry applies it, the Uniform Rapid Suspension system (the "URS"). By registering a domain you agree to be bound by these procedures. This page is a plain-language summary. The authoritative UDRP and its Rules are published by ICANN and prevail over this summary in the event of any difference.
What the UDRP is
The UDRP is a mandatory administrative procedure for resolving disputes where a third party claims that a domain name infringes its trademark rights. It is decided by an approved dispute-resolution provider, not by AIvikings. It exists so that clear cases of abusive registration, often called cybersquatting, can be resolved without court litigation, although either party may still go to court.
When a complaint can succeed
Under the UDRP, a complainant must generally show all three of the following:
- The domain name is identical or confusingly similar to a trademark in which the complainant has rights
- The registrant has no rights or legitimate interests in the domain name
- The domain name was registered and is being used in bad faith
If the complainant does not establish all three, the complaint fails and the domain remains with the registrant.
What happens to your domain during a dispute
If a domain registered through AIvikings becomes the subject of a UDRP or URS proceeding, we will, as required by the policy:
- Lock the domain so that it cannot be transferred to another registrar or registrant while the proceeding is pending
- Maintain the domain in its current state pending the outcome
- Implement the decision of the dispute-resolution provider, or any order of a court or arbitration body of competent jurisdiction, including transfer, cancellation, or suspension of the domain
We are not a party to the dispute and do not decide it. We act on the outcome.
How a complaint is filed
Complaints are filed directly with an ICANN-approved dispute-resolution provider, not with AIvikings. A list of approved providers and the full UDRP, UDRP Rules, and URS documents are published by ICANN at https://www.icann.org/resources/pages/dndr-2012-02-25-en
Abuse that is not a trademark dispute
The UDRP covers trademark-based disputes. To report other kinds of abuse, such as phishing, malware, or fraud, use our Abuse Policy instead.
